I was (mostly) right about Obamacare

The Supreme Court issued its decision this morning upholding almost all of the Affordable Care Act (also known as Obamacare). I haven’t read it all, but I’ve read major parts of it. Contrary to my prediction (see my blog post of June 26th), they upheld the individual mandate as a tax and not as regulation of interstate commerce, and Justice Kennedy joined the dissenters and not the majority. But the big picture is that the ACA is constitutional. This is great news for all Americans, even those who think it’s not. »

Why I think the Supreme Court will uphold Obamacare

The Supreme Court will decide Thursday whether the Affordable Care Act is constitutional. Conventional wisdom is that the Court will declare the ACA (or at least the individual mandate) unconstitutional. Here’s why I think they’re wrong. Since the 1930s, the Supreme Court has ruled that Congress can exercise control over anything that affects interstate commerce. Health care affects interstate commerce more than almost anything else. To invalidate the ACA would be a radical change in the law. Justices Scalia, Alito, and Thomas won’t care, but Chief Justice Roberts and Justice Kennedy will. There’s no principled way to say that Congress can’t regulate health care... »

What President Obama has accomplished

The Washington Monthly is an excellent, small magazine. I’ve been a subscriber for more than 30 years. In 2008, my wife and I had the pleasure of lunch with Charles Peters, the founder of the magazine, who worked for President Kennedy. Paul Glastris, who is now the editor in chief, had an excellent article on what President Obama has accomplished. The Incomplete Greatness of Barack Obama. The subtitled sums it up: “He’s gotten more done in three years than any president in decades. Too bad the American public still thinks he hasn’t accomplished anything.” Glastris also had a sidebar listing President Obama’s Top 50 Accomplishments. Both are well worth reading. »
